Is my employee's social security status correct?
The social security status of some groups of people is not always entirely clear. Is it a case of employment subject to social security contributions or self-employment not subject to social security contributions? Determining the status provides clarity and legal certainty. Shareholder-managing directors of a GmbH, subcontractors or family members working for the company are particularly affected.

Employed or self-employed - how can it be determined whether social security contributions are payable?
It is not always easy to determine whether someone is self-employed or employed and therefore liable for social security contributions. Not clarifying this status is associated with risks. It is not uncommon for companies to have to make five-figure back payments plus late payment penalties for so-called bogus self-employed persons – supposedly self-employed persons who later turn out to be employees. In order to protect yourself from additional claims, the social security status should be clarified when taking up a new employment relationship. We will be happy to support you in carrying out the status determination procedure with the German Pension Insurance to protect you and your company from this risk.
Pension insurance company audit - What can I do if I receive back payments?
It is not uncommon for company audits to result in high back payments. In the hearing procedure, you have the opportunity to comment on the German pension insurance findings. If a decision is issued, the only option is often to go to court.
